Terms of Use

These Terms of Use (the "Terms") are a legally binding agreement between you and Mondrus Computer Consulting Services Inc., a company incorporated in the State of New York, United States ("Mondrus", "we", "us", "our"), the publisher of Spectr, governing your use of the Spectr mobile apps for iOS and Android (the "Apps") and the website spectr.app (together, the "Service").

By downloading, installing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

2. License to use the Apps

• iOS. If you downloaded the App from the Apple App Store, your license to use the App is granted under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA; see Section 14.
• Android and other platforms. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install and use the App on devices that you own or control, for your personal, non-commercial purposes.

In all cases, you may not copy, modify, distribute, sell, rent, reverse engineer, decompile or attempt to extract the source code of the Apps, except where such restrictions are prohibited by law.

3. Presets, filters and other content

The Service gives you access to presets for Adobe Lightroom, filters, overlays and other materials created by us or our licensors (the "Spectr Content").

• You may use Spectr Content to edit your own photos and videos, and you may publish and share the photos and videos you edit with it, including for commercial purposes such as your social media or client work.
• You may not sell, resell, share, distribute, publish or otherwise make available the Spectr Content itself (for example, preset files, DNG files or filter settings), whether for free or for a fee, or include it in any other product or collection.
• Spectr is an independent product and is not affiliated with, endorsed by or sponsored by Adobe Inc. Adobe and Lightroom are trademarks of Adobe Inc. To use presets in Lightroom you need the Adobe Lightroom app, which is subject to Adobe's own terms.

4. Subscriptions and in-app purchases

Some features and content of the Service ("Spectr Premium") are available only with a paid subscription or a one-time (lifetime) purchase. The price, duration and content of each offer are shown in the App before purchase.

1. Payment. Payment is charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase.
2. Automatic renewal. Subscriptions renew automatically at the end of each period at the same price and for the same duration, unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
3. Free trials. If an offer includes a free trial, the subscription starts automatically when the trial ends and you will be charged unless you cancel at least 24 hours before the trial ends. On iOS, any unused portion of a free trial is forfeited when you purchase a subscription.
4. Lifetime purchase. If offered, a lifetime purchase is a one-time payment that gives you access to Spectr Premium for as long as we provide the App, without automatic renewal. It is linked to your Apple ID or Google account and cannot be transferred.
5. Managing and canceling. You can manage or cancel your subscription at any time:
   • iOS: Settings → [your name] → Subscriptions, or in the App Store account settings;
   • Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions.
   Cancellation takes effect at the end of the current billing period; you keep access to premium features until then. Deleting the App does not cancel your subscription.
6. Refunds. Payments are processed by Apple or Google, and refunds are handled by them according to their policies. To request a refund, visit reportaproblem.apple.com (iOS) or Google Play's refund page (Android). We cannot issue refunds for purchases made through the App Store or Google Play.
7. Price changes. We may change subscription prices. You will be notified in advance by Apple or Google as required by their rules, and, where required, asked to agree to the new price before it applies.
8. Restoring purchases. If you reinstall the App or use a new device with the same Apple ID or Google account, use "Restore purchases" in the App to regain access.
9. Changes to content. The set of presets, filters and other Spectr Content may change over time. We may add, update or remove individual items, but we will not remove the core features of an active subscription without notice.

5. Your content

You keep all rights to the photos, videos and other materials you import or edit in the Service ("Your Content"). We do not claim ownership of Your Content. You are solely responsible for Your Content and for having all rights necessary to use and publish it.

Your Content is processed and stored only on your device. We are not responsible for any loss of Your Content, for example, if you delete the App or lose your device. Please keep your own backups.

6. Third-party services

• Advertising. The free version of the Service displays ads provided by third parties. We are not responsible for the content of third-party ads or the products and services they promote.
• Links. The Service may contain links to third-party websites and services that we do not own or control. We are not responsible for their content, policies or practices.

7. Prohibited uses

You agree not to use the Service: (a) for any unlawful purpose or to encourage unlawful acts; (b) to violate any laws or regulations; (c) to infringe our intellectual property rights or the rights of others, including by redistributing Spectr Content; (d) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone; (e) to submit false or misleading information; (f) to upload or transmit viruses or other malicious code; (g) to spam, phish, scrape or crawl, including automated downloading of Spectr Content; (h) for any obscene or immoral purpose; or (i) to interfere with or circumvent the security features of the Service or access premium content without paying for it. We may suspend or terminate your use of the Service for violating these rules.

8. Intellectual property

The Service, including its software, design, graphics, presets, filters, overlays, texts and logos, is owned by Mondrus or its licensors and is protected by intellectual property laws. These Terms do not transfer to you any intellectual property rights, other than the limited rights described in Sections 2 and 3. All trademarks, service marks and logos used in the Service are the property of their respective owners, and you may not use them without permission.

9. Termination

You may stop using the Service at any time by deleting the App (remember to cancel your subscription separately — see Section 4). We may suspend or terminate your access to the Service if you breach these Terms. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination (including 3, 5, 8, 10, 11, 12 and 13) will survive.

10. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or compatible with all devices or third-party apps (including Adobe Lightroom), or that the results of editing will meet your expectations.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Mondrus and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, content, goodwill or business, arising out of or related to your use of or inability to use the Service. Our total liability for any claim related to the Service is limited to the amount you paid us through the Service in the 12 months before the claim, or USD 20 if you have not made any purchases.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

12. Indemnification

You agree to indemnify and hold harmless Mondrus and its affiliates, officers, employees and agents from any claims, losses, damages and costs (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or of the rights of others.

13. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. If you have a concern or dispute, please contact us first at spectr.support@garny.io — we will try to resolve it informally. If it cannot be resolved informally within 60 days, the dispute will be resolved exclusively by the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

If you are a consumer residing in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you will also benefit from those mandatory provisions and may bring proceedings in the courts of your country of residence.

14. Additional terms for the iOS App (Apple)

If you downloaded the App from the Apple App Store:

1. Your use of the App is governed by Apple's Standard EULA together with these Terms. These Terms add to the Standard EULA the rules that are specific to the Service (such as subscriptions, Spectr Content and user content). If there is a conflict between these Terms and the Standard EULA regarding your license to use the App, the Standard EULA prevails.
2. These Terms are concluded between you and Mondrus only, and not with Apple Inc. ("Apple"). Mondrus, not Apple, is solely responsible for the App, its content, maintenance and support, and for addressing any claims relating to the App.
3. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
4. Questions, complaints or claims regarding the App should be sent to spectr.support@garny.io.

15. Additional terms for the Android App (Google Play)

If you downloaded the App from Google Play, you acknowledge that these Terms are between you and Mondrus only, and not with Google LLC ("Google"). Google is not responsible for the App or its content. Your purchases through Google Play are also subject to the Google Play Terms of Service.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. If a change is material, we will make reasonable efforts to notify you in the App at least 30 days before it takes effect. By continuing to use the Service after the changes take effect, you agree to the updated Terms.

17. General

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Entire agreement. These Terms, together with our Privacy Policy and, for the iOS App, Apple's Standard EULA, are the entire agreement between you and Mondrus regarding the Service.

Translations. If these Terms are translated into another language, the English version prevails in case of any inconsistency.
